This document sets out the terms and conditions for your EIGHTPAY business account (the “Account”) and its related services. It also sets out other important things that you need to know. These terms and conditions (“these Terms”), along with our Fees, form a legal agreement (the “Agreement”) between you, the Account holder; and us, EIGHTPAY INC. By pressing the I Accept the Agreement you confirm that you have read, understood, and accepted it.
Introduction to EIGHTPAY
When the word “EIGHTPAY”, “we”, “us”, “our” is used in these Terms, this means EIGHTPAY INC, being an incorporated company in Canada (incorporation number: BC1402036) with its head office and registered address at 422 Richards St, suite 170 Vancouver, BC, Canada V6B2Z4. EIGHTPAY operates the website at https://www.eight-pay.com/.

EIGHTPAY is authorised by Financial Transactions and Reports Analysis Centre of Canada (MSB registration number: M23773769) for MSB activities such as foreign exchange dealing, money transferring, dealing in virtual currencies

Any references to “Company”, “customer”, “I”, “me”, “my”, “you” or “your” in this Terms and Conditions, mean the legal entity in whose name the service is provided and who is agreeing to the Agreement.

We'll usually communicate with you through the EIGHTPAY Account portal. This is how we will provide Account information and tell you about any fraud, or suspected fraud, relating to your Account (if we are able to). It is also how we will tell you if there is a security threat to your Account. Make sure you regularly check the EIGHTPAY Account portal for this information. To help keep your Account safe, download the latest software and version of the EIGHTPAY Account portal as soon as it is available. We may also communicate with you by text message or email, so you should regularly check your text messages and email account.

Information on these Terms
We have drafted these Terms in a question-and-answer format so that they are easy to read and understand. However, if you have any queries at all, please do not hesitate to get in touch via email at office@eight-pay.com
What type of account is my EIGHTPAY Account?
Your EIGHTPAY Account is a 'virtual' electronic money Account that holds your e-money. It may hold e-money in several different currencies at the same time
How to use money in your EIGHTPAY Account?
Once you have e-money in your Account you'll be able to use our services. For example, you can do the following:
  1. Send money to and receive money from other EIGHTPAY Accounts and non-EIGHTPAY accounts;
  2. Change e-money from one currency to another (we call this a currency exchange). The currencies available Might change occasionally;
  3. View information about and manage your Account;
  4. Use the EIGHTPAY payment processing facilities.
You can access the services and the Account analytics through the Account portal on our website.

Can I open a EIGHTPAY Account?

You must be over 18 years old to open a EIGHTPAY Account. When you ask to open your Account, the following apply:
§ you promise that you have full authority to enter into the Agreement and meet the obligations under it;
§ we will ask for certain information about you, where the amount you are opening the Account with comes from, your authorized persons (as explained below), as well as any directors, partners, people with significant control over your business or any beneficial owners. We'll also ask you to confirm that any authorized person has your authority to act on your behalf and that they have agreed to keep to these Terms.
We will only give you access to your EIGHTPAY Account and the EIGHTPAY Account portal once we have all the information we need.
You can't open more than one EIGHTPAY Account, or open a new EIGHTPAY Account if we've previously closed a EIGHTPAY Account that you held. You also cannot open an Account with us if you are a charity, political organization or religious organization.
You cannot open or hold a EIGHTPAY Account if you carry out any sort of business or activity that relates to the following:
  1. dating and escort services;
  2. pornography;
  3. weapons;
  4. trading in precious metals, stones or art;
  5. cashback services;
  6. chemicals and related products;
  7. selling second-hand cars;
  8. debt collection;
  9. or trading in prime-bank guarantees, debentures, letters of credit or medium-term notes.
We can refuse to let you open or hold a EIGHTPAY Account if you carry out any other business or activity that we are not comfortable with. Or we may apply restrictions, which we'll tell you about before we allow you to open the Account.
Please, keep your details up to date and let us know immediately if any information you've given us changes and we will update it.
To meet our legal and regulatory requirements we, or someone acting for us, might sometimes need to ask for more information (for example, if your spending increases). Please, provide this information quickly so that there is no disruption to your Account or our services.

Individual tariffs to suit your business needs

We know that different types of businesses need different things, so we offer flexible tariffs to suit our customers. You can see them via EIGHTPAY Account portal.
Different limits and restrictions will apply to your Account depending on the type of the tariff you choose.

How do I get information on payments into and out of my Account?

You can check all payments into and out of your Account through the EIGHTPAY Account portal. This information will be available to you through the EIGHTPAY Account portal until you close your EIGHTPAY Account.
If you need the information after then, you will need to download it while your EIGHTPAY Account is still active via EIGHTPAY Account portal.

You manage your Account and related services through the EIGHTPAY Account portal, which only you and the appropriate authorized persons will have access to.

Delegating access to your Account and the EIGHTPAY Account portal

The Agreement is binding on you, but you can authorize other people (delegates) to carry out certain activities on your behalf. There are different categories of delegates, all referred to in these Terms as “authorized persons”. We will treat all instructions and actions by authorized persons acting within the limits of their authority as if you had given that instruction or carried out that action yourself. It is your responsibility to withdraw your authority from, or impose limits on, any authorized person (for example, if they are no longer employed by you). Any authorized person must be 18 or over. You are also responsible for all their acts.

What happens after my Account is closed?

  • If you have inquiries or concerns regarding this Policy, don't hesitate to reach out to us at office@eight-pay.com. If you're an End Customer, which refers to an individual conducting business or transactions with a Business User, kindly refer to the privacy policy or notice of the Business User to obtain information about their privacy practices, options, and controls, or you may directly contact the Business User.
